What it says
What this says
As at Fri 9 Oct 2026Executed DPA signed on 12 Jan 2026 between BG-Demo as Processor and Moggill Creek Distributors as Controller. It forms part of the MSA and Order Form. It states no price, availability or response-time figures.
What it is: a standard data processing agreement, executed on 12 Jan 2026. It says it "forms part of the Master Services Agreement and Order Form signed on Monday 12 Jan 2026".
Commits: BG-Demo acts only on documented instructions, keeps data "within the Controller's own Snowflake account", and must tell the customer of a breach "without undue delay". It must also give notice of, and a chance to object to, any sub-processor.
Unusual: nothing off the standard terms. There is no fixed breach deadline, and the DPA prevails over the MSA on personal data.
Not settled: the customer signatory is only "An authorised signatory of the Controller", so the name and role are not shown. Price, tier, service levels and renewal sit in the Order Form, which this document does not reproduce.

Personal data requests
The Processor will help the Controller answer requests from individuals to see, correct or delete their data.
Breach notification
The Processor will tell the Controller without undue delay after becoming aware of a personal data breach affecting the Controller's data, and will provide the information the Controller needs to meet its own duties.
Return and deletion
On the end of the services, the Processor will return or delete the Controller's personal data, at the Controller's choice, unless the law requires it to be kept.
Governing terms
